Terms & Conditions

1. Offer Overview

Brokken Media is offering a 25% discount on eligible video production projects for McLean County Chamber of Commerce members. This offer is valid from the date of announcement through January 31st.

2. Eligibility Requirements

New Clients Only: This offer is exclusively for new clients who have never previously worked with Brokken Media. Existing or former clients (regardless of Chamber membership status) are not eligible under any circumstances.
Chamber Membership Verification: Clients must provide proof of active membership with the McLean County Chamber of Commerce at the time of booking.

3. Project Requirements

Completable by February 28th: To qualify for the 25% discount, the initial project scope must be realistically completable on or before February 28th.
Project Extensions: Projects may continue beyond February 28th, but any work required 30 days after the January 31st deadline may incur additional fees at Brokken Media’s standard rates.
Single-Deliverable Discount: The 25% discount applies only to the first deliverable in any project. If a project includes multiple videos or a series of videos (excluding simple variations of a single core deliverable), only the first primary video qualifies for the discount.

4. First Project Guarantee

Brokken Media offers a First Project Guarantee for all new clients under this promotion:

If the client does not love the final video, they are not required to pay for the project.
This guarantee is based solely on client satisfaction with the creative output—not on the performance of the video on social platforms, marketing metrics, or external results.
Brokken Media will provide revisions within reason to bring the video to a point the client is satisfied with.
Once the client is satisfied with the video and/or chooses to distribute, publish, or use the video in any form, full payment is required.
This aligns with our guarantee: "If you don't love the video, you don't pay."

The guarantee does not include:

Full reshoots or additional production days unless the issue is the direct result of a technical or production error made by Brokken Media (e.g., corrupted audio, lighting problems, boom mic visible in shot, or similar issues that compromise the intended quality).
Major directional changes or new creative concepts requested after the original production day(s).
Additional costs incurred by third-party services (actors, locations, rentals, etc.).

If a full reshoot is requested without qualifying technical errors, the project may still be eligible for revisions, but the First Project Guarantee will not apply.

5. Payment & Cancellation Terms

Standard payment terms apply unless covered by the First Project Guarantee.
If a client cancels a project before production has begun, any non-refundable third-party expenses already incurred will be billed to the client.
Projects canceled after production has begun are not eligible for the First Project Guarantee.

6. Use of Final Deliverables

Until full payment is made (or the client invokes the First Project Guarantee), Brokken Media retains all rights to footage and final deliverables.
If the guarantee is invoked and the client does not pay, the client receives no rights to use the footage in any form.
Brokken Media Rights: Brokken Media retains the right to use all produced content for promotional, marketing, portfolio, or social media purposes, including display on our website or in other materials showcasing our work. Clients grant Brokken Media a non-exclusive, perpetual license to use project materials in this way.

7. Limitations & Additional Conditions

This offer cannot be combined with any other discounts, promotions, or special pricing.
One Use Per Organization: The 25% discount may only be applied once per business entity, including but not limited to any firm, corporation, LLC, sole proprietorship, or organization. Multiple employees or representatives from the same business may not stack or reuse the discount.
Brokken Media reserves the right to decline projects that cannot reasonably be completed by the February 28th deadline.
Brokken Media reserves the right to update or modify these Terms & Conditions for this offer at any time during the promotional period. Individual contracts will be signed for each project and those will not be subject to changes (unless agreed by both parties).
Scope Freeze: After pre-production is approved, the project scope (script, shot list, deliverables) is considered locked. Any changes requested by the client after this point may result in additional fees and are not covered under the discount or the First Project Guarantee.
Creative Discretion: Brokken Media retains creative discretion regarding production methods, editing style, and professional decisions unless explicitly stated in the signed project agreement.
Right to Refuse Guarantee Abuse: If Brokken Media determines that a client is attempting to misuse or exploit the First Project Guarantee (e.g., repeatedly requesting subjective changes to avoid payment), Brokken Media reserves the right to terminate the project and revoke the guarantee.
Safety & Conduct Clause: Brokken Media may cease production without penalty if unsafe conditions, harassment, or unprofessional behavior occur on set.Brokken Media is also not responsible for delays or inability to complete the project due to events outside its control (weather, illness, equipment failure, acts of God, etc.). Deadlines may be extended without penalty.
Liability Limitation: Brokken Media is not liable for any indirect, incidental, or consequential damages arising from the production or use of the final deliverables. Liability is limited strictly to the amount paid for the project.
Client Responsibilities: Clients must provide necessary approvals, brand assets, messaging, and materials on time. Delays caused by the client may void eligibility for the discount or January 31st completion requirement.

8. Agreement

By booking a project under this promotion, the client acknowledges and agrees to these Terms & Conditions.
